Hi all my wife has a defined benefit pension through her work fairly big retailer. She hasn't worked in 5 years through illness and the income protection through the pension has paid her half her wages. They started to ask for forms and letters and they are pushing through the narrative that she won't be able to go back to work so they won't have to provide the income protection...first question is can they do this and secondly with 12 years til retirement should she just draw her db pension with 25 years paid in?

Who's "they"? The employer or the Income Protection insurance company?

Income Protection usually provides an income until the person is able to return to work, or retirement age, whichever is first. So I can't see how an Income Protection company would have anything to gain if your wife is deemed to be permanently unable to return to work. That would usually mean that they'll simply have to continue paying the claim until the specified retirement age.

I'd ask for a copy of the Income Protection terms and conditions and the brochure. The former will give strict definitions, while the latter should explain in plain language how long a claim should continue for.

The employer may also offer employee assistance for dealing with this issue. Or maybe a union if she's a member.
