A husband and father dies intestate the house and all bank accounts were held in joint names with his wife does the wife inherate all the estate without having to go through probate
I had some rather confusing info on this matter, saying that the wife/ mother should inherit one half share of the estate and the children would share the remainder equally but this did not cover jointly held assets between husband and wife
The assets in joint names pass by survivorship, and do not actually form part of the estate. If there are any assets in sole name of deceased, then the rules for distribution on intestacy do come into play.
