How long to close?

Hi there,

I signed my contracts on Friday and noticed that the seller had put a date 9 weeks from now to close.

Is this normal. I cannot wait that long, I have given notice in the house I am renting and need to be out in less than 3. The vendor was pushing and pushing for a quick sale, ringing the ea constantly to see if I had signed contracts, I took on a second job so i could have the balance of deposit ready asap as she wanted a quick sale.

I contacted the EA and he was totally shocked and called her up, she gave some story about needing time to pack and to organise who was helping her pack! I have to do that also, I have bought most of her furniture off her aswell so surely it wont take a furthur 9weeks to pack!?!

She did say she would try and get an earlier date hopefully within two weeks but I am nervous as the contracts say the later date.

What i would really like to know is if she has received my deposit? Was she pretending to want a quick sale so that she could get the deposit and is now just going to sit until she is ready to go?
 
Unfortunately any bargaining chips you had are gone now that the contract is signed. Ring your solr asap and ask them to hold the contract (if not gone back already) and look to have the date changed before sending it out. You may have to go back and initial that change.
 
I would contact your solicitor asap, if he/she hasn't sent the contracts then ask him to change the date and if he has still ask him/her to write a letter stating that you want closure, there is no binding contract until the Vendor has signed and returned the contract so once they get written notice about closure date before she signs and returns the contract to your solicitor then you should be okay.

Some people are so cheeky, putting huge pressure on you and then once she was guaranteed the sale just sit back and relax for nine weeks!

If you signed the contract then you implicitly agreed to everything in it even if you many not have read it all.

If the OP signed the contract, then he has agreed to this provision and the seller should not be held accountable.
 
While it is bad form on behalf of the vendor, the closing date wouldn't exactly be hidden in the contract. If they haven't been sent back already i would play on the vendors heartstrings a little and they might crack unless of course the place they are moving to isn't ready for 9 weeks.
