How high can a fence be over the legal height of a back garden wall

ANyone know how high one can put up a fence on top of an existing wall,which is already at the legal maximum?
ie; Block wall ,put up wooden fence to increase the height and privacy..

once the total heigh exceeds 2.0 m, planning is required.

so if the wall is currently 1.5 m (5') you can add on another 500mm (1' 7")

My friends daughter has a neighbour who has just put up a fence on top of the exsisting wall which is ten or eleven blocks high .
It looks like alcatras! Who would she report this too? Would it be her local planning office?

yes it would.

I find in these cases its better to drop a short note into the letterbox beforehand, outlining both
1. the requirement for planning, and
2.concerns over height from a structural and light point of view
3. a request to remove the fence and reinstate the original wall

then if the neighbour doesnt heed, report away... at least he/she was given a chance.


For your information here is the law:

CLASS 5
The construction, erection or alteration,
within or bounding the curtilage of a
house, of a gate, gateway, railing or
wooden fence or a wall of brick, stone,
blocks with decorative finish, other
concrete blocks or mass concrete.

(is exempt provided....)

1. The height of any such structure
shall not exceed 2 metres or, in the case
of a wall or fence within or bounding any
garden or other space in front of a house,
1.2 metres.

2. Every wall other than a dry or natural
stone wall bounding any garden or other
space shall be capped and the face of any
wall of concrete or concrete block (other
than blocks with decorative finish) which
will be visible from any road, path or
public area, including public open space,
shall be rendered or plastered.

3. No such structure shall be a metal
palisade or other security fence.

I think I should have mentioned that my friends daughters garden is lower than her neighbours..by about a foot.does this change things?
For example if the fence was over the legal height on her side but not the neighbours as their garden is a foot higher.
