(2) For the purposes of this Act, none of the following is a residential property:
(a) a building— (ii) that, since the building’s construction, has never been used as a dwelling.

How about a house that has previously been lived in but is undergoing serious renovations to such an extent that it is not habitable e.g no running water or electricity, completely stripped down to bare walls and floors with all fixtures and fittings removed.
