Handing in notice to current employers?

Hopefully I will be handing in my notice to my current employers this week or early next week after I sign a contract for my new position. In my current contract it says I have to give a month's notice, now I am hoping they will be flexible with this and allow me give 3 weeks but there is the possibility that they will just tell me to leave straight away. If they do this am I entitled to a month's full pay as it says a months notice has to be given in my contract??

I doubt they will tell you to leave right away as they obviously won't want to pay you whilst you are not working.

If it says a months notice has to be given, then thats what you'll have to serve.

I suppose what I am trying to say is the company I work for at the moment do not play by the rule book so they might turn around and say if you want to leave you can get out now sort of attitude. So my question is if they do this do they legally have to pay me for the month as I fear it is something they might try to get away with!

I am going to ask for 3 weeks if not thrown out straight away......works for them as they will be paying me 1 week less!
 
If they tell you to leave straight away (eg which they might well do if you are going to compeditor) they will have to pay you your notice period.

Be prepared to be walked out the door though, if this is the case.

If the employer does not require the employee to work out any part of their notice, the employer is obliged to pay the employee for that period.

Dublander, are you due any holidays? So far as I know, holiday time due can be part of the notice period, so if you were due a week's holidays you'd only have to work three. Hopefully someone will come along with a definitive answer on this.

UPDATE TO ADD:
Just read "The legislation does not address the use of holidays (annual leave) due in lieu of notice. This is a matter for agreement between employer and employee. A previous employer did not want me to work my notice period after I handed in my notice- they claimed they did want me to stay but gave me ridiculous targets for my remaining month and then said I could leave right away but I'd have to sign some sort of disclaimer saying I had agreed to leave without getting paid for my 'garden leave'.

I am currently working a months notice but I am leaving a week earlier as I have accrued holiday days which I am entitled to take
