Agree with Brooklyn above - you get your bill from Council (i.e. redemption figures) and buy out council using the new mortgage set up with new mortgage provider...
House is then yours to do as you please!

This makes it sound very simple and hopefully it would be. However there are two real concerns here:

a.) if the council set the redemption figures will they over-value the property as they do at time of sale and what, if any, recourse will we have?

b.) will the new housing bill remove the right to pay clawback upon remortgaging?

Hi All,

I've been reading all the posts and I'm delighted if its true that they are going to change the bill, but I'm just about to sign my contract the Dublin City Council for and affordable house, should I wait? Or can I still avail of the remortage thingy without having to pay the clawback?

Does anyone know if this bill is scheduled for the current Dail session? or do we have to wait until next Autumn....

It was passed by the Seanad at the end of the last session so should be introduced in the Dáil this session.

Hi All

New to the forum, very interested in the outcome of this proposed legislative change, I was hoping to remortgage this year (2 years in aff. house in Galway) to consolidate personal debts & mortgage. Do you know if there is any kind of a lobby group or anything like that trying to drive this on?

Appreciate any info any of you can share.

Just curious does anyone have any idea when this Bill is due to be passed? I thought it was going to have gone through by now..

i sent of a mail to mr gormley asking about this ,but all i got was a letter back saying that someone will be intouch about the matter shortly ,,i reckon every one should do the same to speed things up

They're planning to start debating it in the Dáil in the next week or two. Although I think with everything else that's going on, those plans have to be taken as tentative.

Yeah, me too....I mailed Minister Gormley who in turn passed it onto someone in D/Environment who's going to reply soon.

I sent off an email to Minister Gormley. Hopefully something willl happen soon cos it seems to be a good time to remortgage with everything going on..

I just asked if there was any update on when the bill would be passed as i am waiting for it to go through before i can remortgage.. it cant do any harm..

does it affect affordable housing going forward only or will it apply to houses already purchased?

i've just had a read there of the bill, and admittedly from a very quick reading it appears to me that it allows you to refinance your current mortgage rather than seek a top up, which would make sense in someway and the council would not allow you to remortgage their portion?

Minister Gormley passed my query onto his Private Sec, and its being treated as a Ministerial Representation, which they treat seriously in any Department...so there's no point in us all getting onto them...I'll post the reply here as soon as I get it.

Got this mail back from the minister this morning

I have been asked by Mr. John Gormley, T.D., Minister for the
Environment, Heritage and Local Government to refer further to your
email concerning remortgaging of affordable housing.
Affordable housing is targeted at first time buyers; those who wish to
get on to the property ladder but cannot do so because house prices are
outside their means. Houses sold to first time buyers under the various
affordable housing schemes at a significant discount from market value
contain a clawback provision, in order to prevent short-term profit
taking on the resale of the house, to the detriment of the objectives of
the schemes.
The Clawback, which represents the State’s interest in the dwelling,
is only activated where the house is resold before the expiration of 20
years from the date of purchase whereby the person selling the property
must pay to the housing authority a percentage of the proceeds of the
sale. After ten years, the amount repayable is reduced by 10% in
respect of each complete year thereafter during which the purchaser has
been in occupation of the home as his or her normal place of residence.

Legislative provision to facilitate arrangements under which a local
authority could agree to its clawback charge ranking in second place
behind a new or topped-up mortgage charge, thereby facilitating persons
in affordable housing wishing to re-mortgage with a private lender, is
being considered in the context of the Housing (Miscellaneous
Provisions) Bill 2008, which is currently before the Oireachtas.
The Bill completed all stages in the Seanad on 10 December 2008. It is
due to be scheduled for second Stage in the Dail this month with
committee stage to follow in early May. The target is to have the Bill
enacted by the summer recess.

I am keen to remortgage(or more precisely change my mortgage protection) and so would like to see this legislation passed through asap.

If emailing someone would help it along, please let me know.

Also, assumming it is passed by Oireachtas soon, how long will it take for the local authorities to get their heads around it?
