Hi
My situation is as follows:
I was made redundant in Ireland in July 2012.
I signed on for about 8 weeks.then i signed off.
I am now working for a company in England -through an agency (it’s “fitter “ type work).
I am not an employee of either the main company or the agency.
I am paid £stg in to my bank a/c which is in Northern Ireland.
I do not have a UK social security number.
I’m not quite sure how the agency does the payroll/paperwork re:me- all i know is that i am paid direct into my N.Irl bank a/c. (the agency does not have my irish pps no.).
All i know is that i did sign paperwork to the effect that taxes etc were my responsibility.
As my situation was not guaranteed/stable- i have been living mainly in digs for the last 15 odd months-time has gone by and i never “sorted out” my situation.
For eg; at the moment- i don’t have any utility bills here etc in my name
I work flat out for 5 or 6 weeks then home to Ireland(republic) for 10 days, rinse and repeat.
I have a wife and 2 kids in ROI. My wife is a stay at home mom.
We don’t claim any state benefits of any sort in ROI,except for child benefit.
The “main” company have said to me that they would pay me a better rate if i could invoice them directly (they mentioned about me setting up as a self-employed contractor; probably not necessary to go as far as a ltd’co’ set up).
There is also a chance of oil rig type work with this company further down the line(could be Aberdeen ,could be Denmark). If that comes to pass it would be 3 weeks on the rig,3 weeks back home in ROI.(i ‘m fairly sure that i would not become an employee of the company if the oil rig work did arise- it would be an agency or more likely an independent contractor type arrangement).

I know that i need to regularise my position as time is slipping by. i know that i need to pay taxes-i’ don’t want to be ducking and diving- but to whom?

-do i need to get a UK social security number (i’m looking at moving into share a house with a few lads- so i suppose i could get some of the utility bills put in my name if that was necessary)
-do i register for tax with UK or with revenue in Ireland.(i know that registration would mean submitting an annual tax return etc) (i think we would just be talking about income tax, perhaps not VAT)
Assuming that i have a choice in the matter- would i be better off going with UK on the basis that i’d probably pay less tax (no USC,more generous tax bands i think). For eg; would i get tax allowances in the UK for my wife and children even though they are not residing here with me?
This working situation is likely to continue for me for the foreseeable future- the oil rig thing is probably a 50/50 chance; either way a return to working in ROI is not on the horizon.
There’s nobody really that i can talk to about this- nobody in my work is in the same boat as me.
I don’t know anyone here that i can talk to- i’m always at work during normal office type hours.
I know i need to get it sorted- so your advices would be greatly appreciated.
Thanks in advance

I doubt that Revenue would see you as not being an employee of either the company or agency.

Your entitlement to child benefit might also be questionable.

You really need to rectify your situation as soon as possible. Go to an accountant or tax expert as soon as you can, otherwise you're storing up significant tax and social welfare problems for yourself.
