I have got the fair deal scheme for my mother with dementia.
I have a home picked there now saying about a extra charge of 35e for silly things I can do for her,even washing clothes it's not covered by the fair deal.
Have any one else opted out of these extra charges.

Hi mcriot29,

You're probably a month or so ahead of me! As a matter of interest, do you have an Enduring Power of Attorney - i.e. what legal basis enabled you to "contract" with the nursing home, apply for the Fair Deal, etc.?

This has become a bit of an issue over the last couple of years, it would be worth reaching out to someone like Age Action to see if they can advise what nursing homes can and should be charging for. Also you should check if you pay these, do you get any tax relief on them? Nursing Homes Ireland which is an umbrella group for nursing homes states the following

EXTRACT FROM THE Deed of Agreement under the Nursing Home Support Scheme

“Long-term Residential Care Services” shall have the meaning assigned to it by the Act and shall, without prejudice to the generality of the foregoing, include:

o Bed and board;
o Nursing and personal care appropriate to the level of care needs of the person;
o Bedding;
o Laundry service; and
o Basic aids and appliances necessary to assist a person with the activities of daily living.

For the avoidance of doubt, Long-term Residential Care Services shall not include: inter alia

o Daily delivery of newspapers;
o Social programmes;
o All therapies;
o Incontinence wear
o Chiropody;
o Dry cleaning;
o Ophthalmic and dental services;
o Transport (including care assistant costs);
o Specialised wheelchairs; and
o Hairdressing and other similar services”

Hi she has not assets in her name so just her two pensions which I collect from the bank.
I did not need anything it was straight forward, but If a house was involved it would have meant going to court to get a ward of court etc.
I have found some
Homes that allows you to opt out of these so called charges.
One in finglas and one in swords they charge 35 e extra but will let me opt out.
The charges are not right I feel.

A ''Specified Person'' can make the Fair Deal application, see page 3 in the link below.

If the Nursing Home Loan is also being applied for and there is no EPA then, I think you need to apply to be a ‘’Care Representative’’ Page 13-16 here;

Interestingly it says you don’t need legal representation to become a Care Representative.
