If a person does not return to work after they have been on Maternity Leave are they entitled to annual leave and bank holidays which would have normally been accrued them had they returned?
Yes they are entitled to accrue annual leave & bank holidays during maternity leave and additional unpaid maternity leave as normal and it should be paid even if they are not returning to work.
