I have recently issued Notice of Termination to a tenant. The notice period runs to late August. I am not expecting any issues.

The annual renewal on RTB is in April.

Should I end the Tenancy now on the RTB site ? Should I renew it in April ?

Does anyone know how to deal with this. Thanks

Should I renew it in April
I had to check this for a family member last year and couldn’t find the information on the RTB website. When I rang the RTB, the agent said it had to be re-registered as long as any original tenants are still in the property so the owner updated the annual registration. Better safe than sorry I suppose.

I had to do this recently. Re-register the tenancy as normal in April and then end the tenancy on the RTB website once the tenants leave. A few extra quid for the RTB I suppose.

I can't see any logical reason why you should not re-register. They are still a tenant.

Also, if there was a challenge to the NoT, that could easily be used against you. You can't raise a dispute against a tenancy that (you say) doesn't exist.

Thanks, that seems clear. If the tenant overholds, should I end the tenancy on th e date the notice expires.

The RTB are adamant that overholding tenants still need to be registered including cases where the tenant is not paying.

Must say I never deregistered my tenancies. No idea what the RTB does then, anyone know?

They will contact you at the annual renewal date and probably threaten legal proceedings if you don't reply or re-register.

What happens if you don't take any action at all, I don't know. I suspect they just leave it on the register, it increases the number of tenancies, a narrative (landlords aren't leaving) that they are very keen to maintain.
