Eircom line monopoly

A bit frustrating and would appreciate any advice.

Am with UTVinternet for last 4 years but had to revert to XL dialup package on 16kbps for last year since moving to rural location.

Direct neighbours have DSL via Eircom. My number fails on online DSL check, but so did theirs before reverting to Eircom as a phone supplier and having had line capabilities verified by local Eircom (nudge-wink) technician.

Rang Eircom and asked if they could physically check line as was done with neighbours. They said they would only send a technician if I was an Eircom customer.

Comreg said it is my suppliers (UTV) responsibility to carry out a physical check.

UTV say their hands are tied as they can only supply on basis of a positive online phone number check.

IrishBroadband's test has failed on basis of line of sight and sattelite connection isn't warranted.

By above are Eircom illegaly retaining a phone monopoly via line ownership?
