EBS EBS - Offered a tracker the day the were stopped

Even though I had received 2 final responses in relation to this case, I had been told I would receive another letter before the examination completed. I have been told this case along with a number of other individual cases with EBS were not picked up by the tracker examination. I would have thought the fact we had made a formal complaint and received final responses it would automatically be included in the investigation. Or is it normal that it wasn't included because they had sent a final response and directed us towards the FSO and as far as they are concerned we were not impacted?
