I have a friend who works a fixed term contract in a private college. She has to takes holidays during the term year but would like to change it so that when she leaves each Summer she will instead get holiday pay. Her employer says he has no objection but that he believes it would extend her fixed term from 39 weeks to 41 and her contract is for 39 weeks a year only. Is he right?
