Do I pay stamp duty if building first home?

Hi - I'm hoping someone can give me some advice please! Myself and hubbie were on Affordable Housing list for 4 yrs but got nothing. My dad has offered to sell us a bit of his garden to build very small house so we are in the process of doing up plans. However, was told yesterday that we'd have to pay stamp duty on the site and dad would have to pay capital gains. Surely as first time buyers and not exactly rolling in cash, there is a way around this? Can we get away with saying my dad is giving me the site? But if i do that will I still get 100% mortgage?

All advice/comments welcome!!
 
There is a specific exemption where a parent give a site to a child to build their home, provided the house is build within a specified period, also no stamp duty would apply provided the rules of the exemption are adhered to
