I gave a deposit recently on a house which has since fallen through. The estate agent is charging me €100 admin fees on this. Surely I should get all my deposit back? Shouldnt the vendor look after the estate agents fees?
Did you get a receipt for the deposit? What did it say?
Normally such booking deposits are fully refundable. The EA's contract is with the vendor; that's the only person they can charge. Mention the Small Claims Court to them.
If you are the purchaser, then the EA does not act for you - he acts for the vendor and he is not entitled to charge you anything. You are entitled to the whole of your deposit back. The vendor is responsible for all costs incurred by the EA.
