When a DB pension scheme is being wound up, obviously against the wishes of the members, what legal rights, if any, do these members have to prevent this happening. In essence, removal of the DB pension, alters the terms of any renumeration package of the employees/ members of the scheme. Does this give the members any legal rights or is it simply a case of the company being fully within their rights to wind it up and the views/concerns of the members are purely an industrial relation issue?

Thanks for your help.

Can you contact the pensions board? They could be of enormous assistance. You will find the NO. in the Govt/State pages of the telephone directory.

It depends on the Rules of the Scheme but 99% of schemes give the employer the right to wind up the scheme when it wants.

It really is an industrial relations issue.
