Hi

I live in an estate and at the back of the houses there is a laneway that a local farmer uses to get to his field anyway there are trees all up the lane so the trees are right behind my back wall, my neighbour cut down the trees behind her back wall, can she do that? also she left the trees lying across the laneway!! I dont know if she got permission I wasnt talking to her, she came to the door last night to see if we wanted ours cut but I wasnt there and my other half didnt give her an answer! I dont want to cut the trees and even if I did I dont think it would be my decision to cut them? am I right?

If they are overhanging your property, you can cut them back to the boundary.

I actually like having the trees there! she cut them down completely, I dont want the farmer coming to my door.

If the farmer liked having them there too then your neighbour could be in serious trouble. This is criminal damage and she could be forced to pay to get equivalent mature trees planted to replace the ones she had cut down.

I don't think she should be cutting down trees at this time of year - due to birds' nesting.
