Could someone tell me:

1. Is it legal for a restaurant or other premises to permit people to bring their own drink (BYO) for consumption, when said premises has no alcohol licence?

2. Is it legal for a licensed premises to permit people to bring their own drink for consumption on the premises, even where no duty has been paid, for example a bottle of wine purchased in the UK?

Answer to Question 2 is yes - lots of people bring in wine /champagne from France for weddings etc.,

Not sure in Ireland, but certainly in Australia there was no problem doing BYO in restuarants who did not have a licence.

Duty would have been paid in the Other Member State.
