I will put it here since the FSO normally investigates breaches of it.
What would people think of in a financial transaction if it was materially breached the Consumer protection Code.
Certainly per High court Zurich V McConnon a contract is not rendered void by breaching it.
The thing is the act is there to protect consumers and if a financial instiution chooses to ignore it by not implementing it fundamentally there is in my view a very strong case for a cause of negligence if controls and systems were deficient and fundamental breach of duty of care
