Complex wage calc: accidentally overpaid & now multinational employer wants it back.

i'd be interested if anyone knows my legal rights or position on this

i get commision payments every quarter

my commision is quite complex and to be honest, i really dont understand it too well - suffice to say that it invloves various different spreadsheets to analyse and calculate.

I mostly rely on a rough rule of it being in the ballpark i expect from past paychecks vs pecentage performance. I have colleagues on the same pay too and i generally ask them if its right.

I recently have been told (along with colleagues) that we were overpaid by about 35% last quarter and that our employer(large multinational) wanted it back.

Does anyone know what my legal obligation/rights are here? I will find it very dificult to make the payment on this even spread over a year, it's still a few hundred a month

At the time I didn't even know i was overpaid - it was pretty much in line with my normal quarterly payments - any ideas on what i must commit to or can i even refuse and just say it was their error?
 
This has been covered here a number of times before, they are entitled to get it back. You are however free to negotiate a mutually agreeable schedule for repayments.

thats excellent stuff leo - thanks very much - i found some other stuff using search but those links are the most relevant

for certain colloquailly and ethically the consensus certainly is that it should of course be repaid - with only a few references to legal obligations. Those few references though also suggest it is required to be repaid...

Ahh well - I was hoping I could tell my employer to swing it (who has reduced my pay by about 25% over the last two years while my revenue and profitability have both increased) but it seems that I just need to negotiate favourable payback period.

and explanation as to how exactly the calculations are arrived at so that you can check for any future errors. If you, your colleagues and management don't appear to be able to keep a proper handle on the calculations then there's something wrong with the system.
