Complex VAT Issue

Hi,

I need some urgent assistence on a VAT issue. I have spoken with my accountant and my customer.... however, opinions don't match. Can someone PM me their phone number so that I can discuss....

I would be very careful about VAT if it's a complex issue. Most people don't appreciate the complexities. If this is abuot how to treat an existing transaction, ring the VAT office and they will give you chapter and verse. If it's a tax planning issue, you should consult one of the VAT specialists in one of the larger firms.

It's in relation to a transaction that will happen within the next few days......

In summary, I'm and Irish co. supplying another Irish co. Goods are transferred in Far East, i.e my terms are FOB. They may / or may not (I don't actually know) ship to Ireland.

Question ? Do I charge them VAT ? I reckon not as the goods may never come into Ireland...... if they do then they will pay VAT at POE....

Any comments....

If the goods are being sold (or supplied) from one party
to another and the goods in question are physically outside of Ireland then they are outside the scope of Irish VAT even if both the buyer and seller are in Ireland with Irish vat numbers

Vat arising from the sale of goods and services follows the physical supply of goods within or to and from a particular jurisdiction which is obviously not the case here.

If the goods are later imported to Ireland, thhen vat at the point of entry to EU will be payable.

This is my understanding also. Can I confirm that if these goods are imported by the customer, he, not me, will be responsibile to pay VAT at point of entry ?

Finally, with respect, is this a qualified piece of advise ?

Ever helpful...... I was simply wondering, what background or experience Aphrodite had. I agree with what was said...
I already mentioned in my opening post that I have already discussed this with my accountant, and continue to do so.

The VAT office is excellent on an issue like this. Aphrodite sounds as if she knows what she is talking about, but if you are questioning her credentials, even with respect, go straight to the VAT office. No charge No doubt And they may even put it in writing so that you can tell your client and accountant.
