Commission Plan, targets have not been set and I havent go commission for 6mo

I joined my new company in March 07.

At the time I agreed to 3 months guarunteed commission and then a commission plan, which was to be agreed and in place in June 07 would come into affect with an on target earning of €5000 per quarter. This commission plan is still not in place.

So for nearly 6 months I have had no target and also been paid no commission. I have asked regularly and often for a commission structure but none has been forthcoming.

What is the legal position on this, my contract states the €5000 per quarter for OTE but I have never been given a target.

Also can the target be back dated?

I feel I have been very reasonable but this is getting ridiculous.
 
I would cut my losses if I were you. This job sounds like a bit of a joke - why hang about when you have been obviously been fed a lot of empty promises.

Maybe you are a bit inexperienced in the work area but you should look upon this episode as a valuable life experience and do your homework better the next time you accept a job.
 
Hi. I've been working very successfully in this area for 10 years. The issue is that the company was taken over by a multi national conglomerate whi can't seem to match all the companies they have taken over (been on a major spending spree) to how things work in the US. They are having issues with the commission structures in all the European Independent Business Units and am not only one nor getting commission. I think workers in US have less rights that they do here and they find ir very difficult. What I really need to know is, as they haven't set out a target are they legally obliged to pay the backdated commission in full, and can they legally back date targets? I have a meeting with the boss next week and I need to know how far I can push things.
 
All of my oustanding commission is now being paid to me before Xmas, and I finally have a commission plan. Which I am way ahead of.
