Cold case review.

What is the position in relation to cold case review of FSOB decisions ?

I know that Harry Whelehan S.C. did a cold case review for them around 2015. In fact, I cannot seem to access that from the FSOB site.

However, I cannot see any other cold case review subsequent to 2015. Is there supposed to be on-going cold case review or is that at the option of the FSOB ?

The other thing about which I was wondering is how files are / were selected for cold case review.

As far as I know, it was just a once off exercise. The new Ombudsman has changed the way things are done, so the findings of this review are probably moot.

The one which astonished me is Case number 23. The Ombudsman found that she should have been given her tracker, but as she had switched to another lender, she had no further claim.

This was Niamh Byrne's case, where she discovered afterwards that Ulster Bank said that it was cheaper to let the FSO find against them as their penalties were less than the cost of doing the right thing.

A weird decision from the Ombudsman which got 10/10 from Harry Whelehan
