No you can't I'm afraid. Not even if you have a court order to pay the maintenance for your child.

If you are about to have your working week shortened and it will impact on your income you should consider varying the maintenance amount.

tanx greenqueen i was just wondering as i had to fill in all details about my maintaince payments on my jobseekers allowance form and was wondering why they were seeking this info??

Because if you're paying spousal maintenance via a court order then they may pay you more for a dependant relative.

Greenqueen is not correct.

As you are paying weekly maintenance above the Increase for a Qualified Child (IQA) rate - €29.80 a week. This is divided by 5 or 6 (depends if you are on Short Time Systematic or Casual work.

Have a look at the guidelines for increase for qualified children.

Have a look at Section 4.

Hope this helps.

Fair point Dublady; I see they have now changed the guidelines since I had this issue with Social Welfare 2 years ago.

Just to point out that Dublady's information is technically correct providing the custodial parent isn't already claiming for the child. E.g. Lone Parent's Allowance. If that's the case; then the non-custodial parent cannot claim for a dependant relative even if they are paying over the Child's rate as mentioned above.

A great relief to see that has now been changed.

Mind you, if your income is going to be reduced for the forseeable future you really should apply for a variation of maintenance.
