Child Benefit for Non-Irish&Irish Parent

Hello:

Have a question about habitual residence, qualification for CB for a couple (one is Irish&the other non-Irish).

After receiving CB for a few years in Ireland, last year for one year, I (non-Irish)had to leave Ireland for a year for family reason.Because the child was small, I took the child with me. While this one year, my partner (Irish) was working in Ireland full time and paying tax etc, diligently.

The question is if the child is allowed to get CB while he was away?

Looked into other sites but couldn't get a right answer for it. If anybody has an idea, your comment is highly appreciated.
 
If I remember correctly, you can have CB only if the child is living in Ireland. This year, I got 3 different letters from social welfare. I need to sent in doc receipt, creche address & phone and a letter from my employer to proof that my son and I are living in Ireland.
 
It is possible to claim Irish Child Benefit (or more correctly part thereof) while the child is outside of Ireland, as part of EU regulations on family payments. It usually happens when an EU national works in Ireland and his/her family remain in their home country. The family must claim the equivalent payment in their home country, and the EU national who works here can claim for Child Benefit, which if granted, supplements the payment received at home to the same CB rate as here.

While you say you are non Irish, the important next question is, are you European or non European.
If you are European there is regulations there in relation to claiming child benefit while you are not in Ireland but living in the EU.
If you are non European you have no entitlement to claim CB while the child is not living in the country.

Having experienced requirement to submit paper work to the department back and forth, I was also wondering if its possible for my spouse(Irish, father) to claim the benefit instead of myself. That would save submitting all these requirement, provided the child is living in Ireland.

Or does it have to be a mother?
 
Yes it is possible for the father (with the mothers consent) to claim CB for the child as long the child is living in Ireland or the EU as he is the working parent and paying PRSI in Ireland
