Just looking for some advise on CAT filing
I recently became a beneficiary of a will and inherited some land from a deceased relative. The valuation of this land will result in a CAT liability as it's above the threshold. The deceased relative was resident in a nursing home for a number of years before their death, and this was funded through fair deal scheme (HSE Loan). I have recently made a payment to Revenue and this loan has been repaid in full (loan needed to be re-paid within 12 months of date of death).
I have two questions:
1. When does the CAT filing need to be done by? The valuation of the estate was carried out in May 2025, however probate has not been granted. Information on the Revenue website would suggest that the IT38 filing needs to be done by 31st October this year. I have got other advice which suggests that the filing can't be done until after grant of probate.
2. Can the payment which was made to settle the Fair Deal loan be used to offset against the CAT liability?
Any advise would be greatly appreciated
