car damage from electric wheelchair! help

Go and see your solicitor. What the guards are advising sounds right- you will have to sue her for the damages. You should give her an opportunity to have a motor assessor check the value of the damage done before you repair the car ( but this is not fatal). Get an estimate, or get it done, and then look to her to reimburse you.
 
Hi all , The saga continues. First I went to my local dealer and got an estimate for the euro975.00 damage. I posted the bill. I heard nothing so I posted it again registered mail. I then had a visit from the womans son all guns blazing!!! who eventually agreed to get the damage repaired but at his local panel beaters. I agreed with my closing statement ,,I dont care who fixes it as long as its the same as it was before the damage. He told me where to go and he would fix up the bill as the panel beater was a freind of a friend.I had no problem with that. Bear in mind my jeep is just 2 years old and now worth 22k.Well guys I colected the jeep, and the door which he repaired is a different colour to the rest of the car!!And to add insult to injury there are paint bubbles and drips of the paint on the door. The situation is now worse.We told the panel beater that it wasnt acceptable and he basically said paint never matches exactly and he wasnt been paid enough to spray the whole side of the car...so tough. He rekoned in time it would blend in!!!We were rightly miffed as you can imagaine.So my car is now worth s@@@ . I brought it back to my main dealer and they said it will now cost even more to repair the situation and it will be euro1500 to sort the mess. I was thinking of sending a soliciters letter to the lady, but my husband is saying let it go and just suffer the cost...as this lady is old , in council accomodation and you just dont know what you are getting into. I am really cheesed off as I dont have 1500euro to throw about. Also it has devalued the car bigtime, and I am just thinking to myself maybe I will just hold on to the car for years now and sell it when its 10 years old instead of what I had been doing, as its not worth s''' now,,,excuse the French!!!!
 
Sorry to hear of your difficulties. For the benefit of others in similar positions in future, I think you were crazy to hand over your car to any 'friend of a friend' panel beater - that has got to be a recipe for disaster. Rightly or wrongly, I understand that if the lady doesn't have resources, any legal action is likely to be fruitless. Even if you win a court judgement, you won't be able to enforce the judgement.

WOuld these guys be any help at all?

I'd wonder if you'd be better trying to reach a negotiated solution with her and/or her son?
 
Ring the son, and arrange to meet him, at the panel beaters premises.

Bring your own panel beater and hammer out a solution.
 
Being an ex-panel beater, I would agree that it is unwise for anybody to agree for a 'friend of a friend panel beater' to repair you car. Inevitable it will be done 'on the cheap'.

In your situation, I would say that while the unmatched paintwork must look bad it will not diminish the value of your jeep by as much as you seem to think it will. Yes it will make buyers question why it was resprayed, but any pre-purchase inspection will show that it was merely a door repair as opposed to major crash damage.

In summary, yes, if possible, have the door repainted/repaired to it's exact colour, but don't despair if you cannot get this lady to pay up for the cost - your vehicle will still be worth close to what it pre-accident value was.

Hi All thanks so much, Silvera you have made me feel a lot better. The insurance bureau cant help me in this situation, so I phoned my soliciter,after a long chat, she advised me to let it go, ...either pay for the cost of re doing it or leave it. I am going to leave it....you live and learn!!!!!
 
If you are driving a car as new as that I would assume that you have comprehensive insurance. Can you not claim it off that and let them chase up the little old lady..

This might affect your NCB if no recovery comes from "the little old lady"
