Can you do Court and Ombusman at the same time?

So if you have say 10 complaints against your bank.
Can you pursue 5 with ombudsman and 5 with the court?

In theory, yes.

But there is a section in the Ombudsman legislation where he can decline to deal with a complaint, if he feels it's more suited to another means of resolution.

I would guess that he would exercise his discretion on this one and tell you where to go.

The whole point of the ombudsman is to avoid court. In any case what ordinary person can afford to go to court?
