Can I quit a one year lease with one month's notice?

So we've been approved ofr a mortgage by AIB (yay) and we're starting to shop around. I was wondering does anyone have any advice in relation with dealing with rental leases and how/when to approach landlord about possibility of breaking a lease.

Ours is up at the start of febuary and im afraid we will find a house soon and want to jump quick. We realistically cant pay rent and a mortgage, even for one month, so we'd have to be clear from renting. Is it true thati can give one months notice, and also get my deposit back or do i have to live out the full 12 months if i want my money back?

I also think i paid a month in advance aswell as a deposit, so that means im free of the rent a month before im due to move out? Correct?
 
Even if you had an offer accepted tomorrow, you might be lucky to have the keys by the start of February.

I'd imagine you should be considering the possibility of discussing a month-to-month agreement with your landlord after your lease is up.
 
After Chrstmas get in touch with the LL and ask him what the story on the lease is after year 1. As proposed by leon you should aim to get a rolling month by month lease. In my experience it will roll automatically on to this as long as you don't sign a new lease anyway so perhaps you should do nothing and if the LL does not get in contact the default is months notice.
Re: Allowing last months rent to be taken from deposit. This is not the case unless the LL agrees and why would he ? He has a lot to lose and nothing to gain if you leave the place with something being broken/bills not paid/etc that you were responsible for. Not saying for one minute this would happen but it's a scenario that could and therefor unless he knows you very well he will not agree to.
 
After 6 months in a property, the tenant acquires Part 4 rights. These include the right to remain in a property at the end of a fixed term lease. A nother advantage fgor the tenant is that this Part 4 rights include the right to leave/break the lease at any time (as long as it is not still in a Fixed term lease) by giving written notice and the correct notice period (between 1 and 2 years in ptoperty requires 42 days).

A tenant does not have to sign any further lease at the end of the fixed term (unless they want the extra security of the fixed term). However, the tenant should advise the landlord between 3 months and 1 month prior to the expiry of the fixed term that he wishes to remain in the property otherwise, the landlord has the right to claim any reasonable costs he may have incurred in expectation of the fixed term lease being terminated and having to find new tenants.

Failure to notify the landlord that the tenant wishes to remain does not preclude the teant from staying but as mentioned above, he may be liable for any landlord's expenses.

I'm taking this part to mean you paid a month in advance + a deposit.

Rent is payable in advance so if you moved in on Feb 1st that would cover the rent to the end of Feb and so on. So there would be no free month due to you if you move out at the end of any month.
