I can't see how the company had a choice.... give the jobs to someone who won't do it I say....

That sort of behaviour by its employees gives a purveyor of a mind altering drug a bad name alright.

SIPTU, which represents the staff, said it would not be appealing the decision unless asked to do so by individual employees.

If even their union accept the decision without argument it is completely justified.

I know some might find it surprising but trade unions (and in particular) Siptu adopt a zero tolerance approach when blatant health and safety breaches of endanger life and limb of their members and other employees.

As a Safety Professional, disciplinary action was justified.

However what other corrective actions have their employers taken?

and what preventive actions are they putting in place to prevent it happening again?

Will they look at the cultural and behavioral issues that let these activities take place in first place. Such behavior is rarely limited to one section of a large work environment.

There have been many other forklift related/ prank type incidents in the logistics/warehousing sector, and indeed search YouTube for pranks and you will see other similar events

Still gives H&S&E professionals warm fuzzy feeling of be justified occasionally :D

Yes, it is essential that the company examine the root cause of the behaviour and take preventive steps to stop it occurring.

Do these guys have a criminal case to answer. Does management have a criminal case to answer? Has the incident been reported to the HSA?

While employee's have duties of care,and to carry out tasks as instructed etc. management also have a duty to supervise, train etc.

Been sacked is probably sufficiently harsh not to warrant proceedings. H.S.A, if involved would rather seen measures to prevent re occurrence , rather than punish. Had someone been hurt of course it would all be different!!!, employees looking for compensation for injury due to lack of management supervision, or lack of training and awareness. When investigated many apparent injuries actually where misguided pranks gone wrong and attempted to cover up.

Good workplaces have a culture where an incident can be reported with out fear of punishment or repercussion. That way the little incidents get sorted out and don't lead to the big one( death or huge material damage).

Punishment would not be effective and indeed could be counter productive.
