Benefits and personal injury settlement

Hi,

Is a personal injury settlement viewed by social welfare as income or savings/capital? Say, for example, I get disability allowance and am therefore allowed a €50,000 capital disregard: if I receive €50,000 personal injury settlement, does that mean that I can keep that money without it affecting my payment? Asking for a family member.

The Answer is not straight forward, certain types of personal injury compensation awards are exempt from means testing for certain SW payments , if for example its a straightforward award from an accident, then I would say yes but if its an award for Hepatitis C, or Institutional redress scheme (in essence state funded compensation schemes) then no, these awards are exempt from in link attached .
