PTSB Banks must give additional information on consolidation of loans under the CPC

If you read the Consumer Protection Code 2006 it states on page 24 under mortgages it states (item numbered 10)

"Where a mortgage is offered to a consumer for the purpose of consolidating other loans or credit facilities, the regulated must provide the consumer with a written indicative comparison of the total cost of continuing with the existing facilities and the total cost of the consolidated facility on offer."

If these facilities were a remortgage and also included other credit facilities , then there is a possibility if no comparison was given as noted in the previous paragraph that the bank broke the Code, so if all these circumstances arose in this or other contracts there maybe consequences due to this breach.


PS: In order for the above section to apply it appears to relate where there has to be consolidation of loans. We dont have enough information in this case to establish was that the position, but it would be interesting if there was any customers ever given this comparison if the above section 10 of the Code applied.
