Back to work allowance

Can anyone advise if you can claim this if you are returning to a previous employer? all other criteria ie 3 years on an illness or disability benefit would have been met in this case

Here's part of the qualifying criteria from the SW website:

Nature of Employment:
Payment can be made in respect of all jobs unless there is evidence that the employer laid off an employee in order for the BTWA applicant to qualify for the Allowance. Where there is doubt the application should be referred to the local SFSS Facilitator for investigation.

Doesn't mention anything in the guidelines about returning to a previous employer other than the above.
