Asbestos used by builder as infill?

Had issues with builder and engineer. Now discovered that they did not dispose of garden shed roof properly as requested, but used it as infill for foundations - the building works were a huge job, and I specifically requested that the builder dispose of asbestos roof correctly - small roof - 10 by 12. Where do I stand with this? Can the builder be prosecuted for this? We only discovered it after drilling down a part of the foundations. This leads on to the issue also that the foundations were not done as originally specified by the engineer, but I understand from new engineer, that they are satisfactory. Any comment/advice?

Not 100% certain if you can get a reading done on where the asbestos was buried, but something's telling me you can. Very dangerous thing to do and i'm sure it's illegal but I cannot tell you exactly what you can do.

No offence but judging by all your problems, you just need a good solicitor on retainer and not the advice of some people on an internet forum.

Hi! Pretab, the issue with the asbestos is sorted - but unfortunately the issues all arose from one building project - would never do renovations again!

Yes, would love to hear as well. Problem only discovered a week ago and sorted already, that's some going.

The foundations in the area where the asbestos was were dug up - the asbestos was in the floor slab rather than the foundations - it was part of remedial work. Asbestos is gone, but floor has to be redone - or a section of it where the builder dumped the asbestos shed roof. The builders worked until they got back to the old foundations where there was no asbestos in the slabs - they went a little beyond this to check it out. The asbestos was broken corrugated sheeting. Inspected by engineer as they finished digging it. The work was done as part of remedial work, so done quickly as the project was just extended slightly. No big mystery!

Sadly the asbestos dust from breaking up seems to have been already dispersed into the groundwork. THANKS FOR THE UPDATE.

Noproblem, can you explain about this - the shed roof was broken up by the previous builders and put with the shed blocks as infill. Just now when I had it removed, it was removed by hand, pice by piece. How do I know or would I find out if it had dispersed in the the groundwork? Although the asbestos was in the floor slabs, new foundations were dug underneath this and filled in with proper infill. Is there anything else I need to test/do? Would be grateful for the info.

Asbestos is only dangerous when it releases particles into the atmosphere. If it is sealed or encapsulated in something, it is not a threat. The biggest problems occur when it is disturbed by breaking it up, drilling into it and so on. Hence removal should always be undertaken by specialists. In many cases the best thing to do is leave it in place, especially if it has been covered in some way and cannot be disturbed.
