An employee at the company was recently let go (by my mamager) after 4 weeks work. She had not yet been paid, contract issued or filed any papper work (Still waiting on P45 from last job). She had committed an offence - lets just say it would be classified as gross miscounduct, it was witnessed by employees and a customer. It was later reported by a customer to our line manager.
The manager when he found out the next day called her to the office and said that she was suspended with pay. It was a very short conversation as she was collecting her belongs 5 minutes later, and handed back her keys etc. According to her she recieved a phone call that evening saying that it was best to resgin and she would be paid her 4 weeks. She refused and still has not been paid, but sent a letter stating what she was owed. She has had no further contact from the company.
Does she have any recourse for unfair dismissal and to get paid. She was never given a reason for dismissal, notice or a hearing. Is this legal? Is she afforded the right to due process? How would she address this.
I do not agree with what she did, but I also do not agree with how it was dealt with by the manager and has got everyone worried about how we could be treated in the future until we reach our 1 years service. Any ideas?
