Hi,

I am writing on behalf of my mother. She scalded her leg today on her lunch break in the work premises an accident caused by herself. She is badly brunt and had to come home from work due to it. It will be unlikely that she will make in for the rest for the rest of the week. Should she get paid for this time off or will it be at her own expensive.

Thanks for any advice given.

Minnie.

I would say at her own expense as it was totally her fault. however, it would be at the disgresion of the employer if they were to pay her or not

It depends on whether she's full or part time and what her employers own rules are. Depending on her PRSI status, she may be able to claim for sick leave benefit, if she obtains a medical cert. Whose fault the accident was isn't especially relevant for these purposes.

Surely if she'e entitled to sick pay then it doesn't really matter who's fault it is? That's like saying I shouldn't get paid for being absent from work due to a toothache because they're my teeth and I ate the sweets that made them ache!

If she does qualify for Illness Benefit from Social Welfare, she will not get paid for the first three days of illness.

Thanks guys,

She wouldn't apply for benefit and she wouldn't go to her company looking for pay she was just wondering would she get paid. Her company doesn't normally pay for any kind of sick leave. Terrible really, considering she's there 20 years.

Thanks anyway.

Minnie.

have a look at citizens information, e.g. here and here. There is an obligation on employers to provide safe conditions of work, just because she scalded herself does not mean it was her fault.

Because she won't take any longer than this week off and she would lose the first three days. Not worth it for one day considering she'd have to pay for a Drs visit.
