Accessing deferred benefits early

Hi all,

I'm a member of the SPSPS but I have an eye on maximising my options in my 60's down the line. I'm paying into an AVC PRSA alongside the main scheme. It states a number of times that if you leave the public service before retirement age that your benefits are deferred until your normal retirement age (likely to be 68 for me) and cannot be accessed early.

My question is, say I work for the public service for 30 years, from 25 to 55, and then spend 5 years in the private sector, is there anything to stop me re-entering the public service at 60 in theoretically any role, and shortly after applying for cost neutral early retirement, hence accessing my scheme benefits 8 years earlier. Probably a bit disingenuous in applying for a role on this basis but is it possible or are the earlier benefits still deferred?

Any thoughts appreciated.
 
The circular on CNER states that:

"All applications for CNER will be considered on an individual basis having regard, in particular, to business needs."

Could you be snookered in that the application is turned down?
