I am reminded of the Donegal case in the High Court a few months ago...the 280K loan/gift with no agreement in their case. (Mind you Ms Justice Deirdre Murphy took a strong view on that friendly loan/gift)
The way the sum has been described and presented is that it is being paid back at a particular sum - and it is this monthly sum that enables this person to justify requiring an excessive increase in maintenance.
