Hi.

Miss X states in her will that she wishes to leave €100,000 in a trust fund for her sister Miss Y to be administered by the executors. The executors are to release funds to Miss Y on a drip basis purely for day to day living expenses. When her sister dies Miss X has stated in her will that the remainder of the trust fund is to be divided between her 3 nieces.

Miss Y states in her will that on her death the entirety of her estate is to go to just one niece.

Who inherits the remainder of the trust fund after the death of both Miss X and Miss Y assuming Miss X dies before Miss Y?

Thanks,

When her sister dies Miss X has stated in her will that the remainder of the trust fund is to be divided between her 3 nieces.

Does this not answer the question. After Miss Y dies, the trust fund is no longer hers. It is to be divided between the three nieces.

Thanks. I thought that the fund might form part of Miss Y's estate rather than Miss X's.

So that means that Miss X's estate cannot be fully finalised until Miss Y dies even if Miss Y survives Miss X by 20 years
