Buyer is trying to pull out after signing contracts

Re: solicitor walked away after buyer signed the papers Under instruction from you, at that stage your solicitor will issue a 28 day completion notice. If they do not respond to that they are in breach of contract. You can then invoke Invoke General condition 41 of the contract You...

Buyer is trying to pull out after signing contracts

Re: solicitor walked away after buyer signed the papers FYI. This is not the way the property market works and that is why people sign legally binding contracts.

Buyer is trying to pull out after signing contracts

Re: solicitor walked away after buyer signed the papers If the contract was subject to finance ( get out clause if the bank withdraws finance - standard clause for the past two years along with life assurance) and the bank wasn't happy with the survey and subsequently either lowered their...

    Letter of Offer expiry

Your buyers contract should have an escape clause if mortgage is withdrawn. This was reintroduced due to falling market. It is highly likely that the property will be revalued when the offer expires and your mortgage while not withdrawn will be reduced accordingly. Hard times.

Closing in 3 weeks - head wrecked

I don't know? He is a very tricky guy and will do what he can to get it back. We have a copy of his mortgage approval which is good for another month so I really don't know what he will do. Can we force him to complete as he has changed his mind at the last minute? Unlikely but there has been a...

Closing in 3 weeks - head wrecked

Well it happened, he pulled out today with just 10 days to closing. Am very p***ed off to say the least. Will wait to see what my solicitor has to say. He will try to get his deposit back I'm sure! I'm wondering can we sue him?

Closing in 3 weeks - head wrecked

The contracts are signed and all conditions have been met on both sides. ( Although buyer did try to alter the contract after the fact for no good use or reason). It's done and dusted but I just don't trust the guy to come good in the end and as he works in legal circles ( and is politically...

Selling a house to my parents

Don't think so... Can I avail of first time buyer relief if I have previously inherited a house? Yes. An inheritance is not regarded as a previous purchase and the first time buyer relief can be claimed provided all other conditions of the relief are satisfied. From [broken link removed]

Selling a house to my parents

Thanks for the info. on stamp duty. I had heard something like this before but have no specifics. Will look into it. You're right, it is a a load of hassle. Will check with my solicitor when I get around to making a will. I know I know! Have put it off as my husband and I can't agree on...

Selling a house to my parents

The house is used as a holiday home. It's in West Clare and we all live in Dublin. It has never been rented and will never be. Their decision, not mine. I'd be of the "Rich Dad, Poor Dad" school. Anyway legally the house is mine, morally it is theirs. They've paid the mortgage and paid for...

Selling a house to my parents

Thanks, but some points. If I went to sell the house today I figure it wouldn't fetch much more than I paid for it, houses in Clare are not selling. I'm not trying to do a "nudge nudge wink wink", just trying to transfer the property for the minimum stamp duty and with the minimum hassle. It's...

Selling a house to my parents

Hi I have an outstanding mortage of €100000 on a house in Clare that I bought with my parents ( but it's in my name only) about 10 years ago. I paid £80,000 at the time and extensive renovations were carried out. My question is... Can I sell it to my parents for the amount of the outstanding...

    €200 Property tax Ireland

I really thought I didn't owe this but am now confused. I own a property in West Clare ( not rented, used a holiday home primarily by my parents) which I would consider my principal private residence for tax purposes but I live and reside in my parents house in Dublin. Do I still have to pay...
