Stamp Duty on new property

All,

quick question, buying a new house over 125sq meters as owner occupier (not 1st time buyer) that will cost €365,000. The revenue website states ([broken link removed]):-
New houses or apartments which are purchased by an owner occupier (including a first time buyer) where the total floor area exceeds 125 square metres are charged with duty, at the appropriate residential property rate as per the table above, on the site value (excluding VAT) or one quarter of the total value of the house including the site (excluding VAT), whichever is the greater, subject to clawback.

Bases on this I calculate I will be assessed on €365K / 4 = €91,250 therefore I am exempt from stamp duty as owner occupier as this is under the 127K threshold. Is this correct?

If the site value ex. VAT is also less than €127K then you are exempt from SD.
 
does this depend on a floor area certificate existing? i.e. if no such cert exists, then stamp duty will automatically apply?
