PTSB PTSB 1 year discounted tracker - Central Bank has deemed them not impacted.

Hi,

Any word on the FSPO Tracker decisions to be published before month end. There are PTSB customers highlighting the 12 month "Discounted Tracker" issue. Hoping FSPO will have made a ruling in our favour??

Doesn't look like there was a decision on this group today, is that correct? So when might there be more decisions ? Are we expecting more from ombudsman? Still more questions than answers unfortunately.

No, I didn't recognise the discounted tracker in any of the cases today.

I wouldn't expect him to publish another bulletin for some months.

Folks, my case is with fspo for adjudication since November... so given the volume of cases, it was probably never likely to get a decision by now. Presumably what was published related to decisions taken in H2 2019.
 
PFS, at least it's good to know that there will be an adjudication in due course. No news is still good news for now. But we will probably have to wait again for months. I will park the thinking about it again for another while.

Has any of our cohort received a decision from FSPO? My appeal now over 7 months awaiting adjudication... DDay must be close...

Did u complete exchanges and is it now awaiting adjudication? Doesnt sound right that with FSPO that length of time without a decision. I was told 6-12 months when exchanges completed.
 
Had completed exchanges in August 2018 and then in late January 2019 after some Tracker decisions were publised by the Ombudsman's office, i submitted some extra information. The exchanges were then finalised end July/early august 2019 and still waiting on a decision.

I am also currently in adjudication stage and waiting on the Ombudsman to issue a Preliminary Decision from 6th Feb 2020 and my initial complaint with the Ombudsman was submitted in Mar 2018. They said in Feb that this preliminary decision could take between 6- 12months.
 
I wouldn’t think decision will be soon. I submitted my case December 2017. Investigation ended September 2018. March 2019 they said it moved to drafting a preliminary decision. Now 16 months later still nothing.
Once you move to drafting decision expect 12-24 months.
 
I was told in April 2020 it would be 2-3 months but then considering I was told last September it would be by Xmas 2019 I would agree with the 12-24 months timeline!

It's possible that the Ombudsman has issued a preliminary decision on this issue.

And the customer and ptsb are making further observations.

It is also possible that the Ombudsman has issued a final decision on the matter and is waiting for the 35 days time limit to appeal to the High Court has expired.

It would make sense for the Ombudsman to finalise just one and see the reaction. Especially if he has found against ptsb.

There would be no need for him to issue decisions on all your cases.

PTSB might also concede on one individual case & the FSPO would then not have to make a formal decision. Not sure about the impact of such a bank concession on other customers in same cohort though.

The guidance they gave was 6-12 months from November 2019. Remember everything had been on hold with CBI Tracker Review up to H1 2019.
