IMO you should NOT register this as a tenancy and you should immediately change the locks to your former garage. The guy MIGHT try to get the PRTB involved and yes you MIGHT be landed with a fine and you MIGHT have to go to court to argue that the PRTB have no jurisdiction and you MIGHT lose, but I don't think you will have to do any of those things because it's far too grey an area this. The guy is some chancer living under your nose and withholding rent from you.
