Legal responsibilities of Creche operating in housing estate

I would appreciate if someone could let me know what are the responsibilities of a creche which is operating on the ground floor of an apartment block.
If the premises are structured in a way which allows for access by low glass canopies, railings etc to the apartments above, creating a security risk for apartment owners, is there legal liability on the owner or landlord to address this.

If the playground area of the creche is not secured properly and children from the estate regularly use it as a public playground outside of creche hours what is the legal position regarding nuisance to other residents and also liability in the case of an accident?

Some of these are planning and building regulation issues - does the development have planning permission for this use? Do they have a fire safety certificate for this use?
 
Yes, as far as I'm aware the incorporation of a creche was part of the planning process for the estate. It is run by business people who rent the premises from a landlord.
