Housing list appeal.

    How does somebody go about appealing a decision to refuse an application to be included on a local authority housing list?The claimant is a single person in receipt of Disability Allowance who has been deemed not to satisfy the means test due to an inheritance of part of the proceeds of the sale of a house. The value of this is just above the 30,000 euro income threshold.

    Could you reduce the amount below the limit and reapply?

    Yes,if it were possible to overturn the terms of the will and distribute part of his share equally among the other beneficiaries. Legal advice received to date suggests this is not possible in law.

    How much is it over. Can he reduce his inheritence the day he gets it to bring him within the limit.

    Approximately 30,000 over the limit based on current market values. The question is how can that be done legally and with documentary evidence showing that it has been done.
