Hi all , i will be leaving my current employer in September , I have not taken any holidays this year at all so i am trying to work out what i will be entitled to when i leave on Sep 1st.

I usually get 23 days a year and i thought that i would work out my holidays from January to Sep based on a pro rata of 1.926 a month which is 15.5 days.

However i noticed on the governemnt website that the following applies.

There are three different ways of calculating your annual leave:

  • Based on the employee's working hours during what is called "the leave year", which runs from April to March. An employee who has worked at least 1,365 hours in the leave year (i.e. an average working week of 26.25 hours) is entitled to the maximum of 4 weeks annual leave. Many employers use the calendar year (i.e., January-December) instead of the official leave year to calculate entitlement.
Based on the above , if i have worked more that 1365 hours from Jan to Sep 1st should i be claiming my full entitlement of 23 days when i leave?
