Gym using competition for instant telesales contacts

A certain gym is running a competition for free membership at the moment. A friend filled out their online form for the competition and checked the boxes indicating that they did not want to receive news or any special offers.

Within 3 hours of entering the competition they had a member of staff from the gym ringing them to sell them memberhip. I thought it was weird that they should push membership purchase before the draw had even taken place and that they should even use the contact details when this person had checked the boxes to say no to contact from them.

Just very cheeky. Does anyone else think it's a bit much?
 
Its more than a bit much. They cannot do this under the data protection legislation - information can only be used for the purpose for which it was provided. I'd remind them of that.
