Faulty fans installed in house

Hi all,

We recently paid €2,500 to have a new fan system installed in the attic. Easy enough job but turns out the lad installing it mixed up the pipe exhaust from en suite with the extraction pipe. There were foul smells in house for over a month before we copped the mistake. Weve been sick - respiratory, rashes, headaches etc because of this mistake. Baby was so ill for weeks that doc asked of we lived beside farm or open sewer. Anyway we contacted company and complained but have heard nothing back. Have we any redress in this?
 
In terms of redress, you’re certainly entitled to have the problem rectified by the company concerned.

Given their failure to engage however, you may need to pursue legal action.

Small Claims Details​

The Small Claims procedure is a service provided by District Court offices and is designed to handle consumer or business claims inexpensively without involving a solicitor.
The local District Court Clerk, who is the Small Claims Registrar, processes small claims.
Type of claims dealt with
  • a claim for goods or services bought for private use from someone selling them in the course of a business (consumer claims)
  • a claim for goods or services bought for business use from someone selling them in the course of a business (business claims)
  • a claim for minor damage to property (but excluding personal injuries)
  • a claim for the non-return of a rent deposit for certain kinds of rented properties. For example, a holiday home or a room / flat in a premises where the owner also lives
The claim cannot exceed €2,000. The current fee to make a claim is €25.
Where possible, the Registrar will negotiate a settlement without the need for a court hearing. If the matter cannot be settled, the registrar will bring your claim before the District Court (which you will have to attend).
Remember, it is possible your claim will be disputed or a counterclaim made against you.
If the other party admits your claim he/she is required to notify the Registrar's office and make payment. If they do not respond to your claim, the District Court will make an order.

The claim can still be for an amount less than 2000, assuming the OP is not looking for a full refund

For example, if the cost to fix the problem by a third party was, say, 500 euro, you could make a claim for this amount from the original company via the SCC.

This assumes the original contractor has been given reasonable opportunity to correct matters. If it’s causing health problems however, they would surely have a responsibility to respond urgently.
 
The health of your family should be your first priority. Fix the issue (use another company if that speeds up resolution) and then file your complaint against the original installer.
