Employer charged too much BIK

Hello

Employer charges too much BIK for previous 5 years.
Discovers mistake and admits it is an error by its staff.
Tells employee to claim back from Revenue.

1) Does employee have to go back to Revenue or can they insist that their employer pay them back as it is their mistake?
2) If not, and Revenue only allow claims back 4 years, can employee claim money for 5th year from employer?

I would have thought that the employer should file an amended P35 with the correct gross pay for each year.

Then you can apply for the refund of the last 4 years.

Don't know what you can do about year 1.
